Supreme Court Grants Teesta Setalvad Conditional Approval for International Travel Following Kapil Sibal’s Arguments

In a recent Supreme Court hearing, Teesta Setalvad received a significant legal reprieve. On August 20, 2024, the Court allowed Setalvad to travel to Selangor, Malaysia, from August 31 to September 10, 2024. The purpose of her trip is to participate in an anti-racism conference. Key Conditions for International Travel

During the hearing, Kapil Sibal, representing Setalvad, argued that his client should be permitted to attend the international conference. Sibal assured the Court that Setalvad’s travel was crucial for her role as a panelist at the 12th National Conference on Non-Discrimination, organized by Pusat Komas. Despite initial resistance, the Court granted permission under two stringent conditions: Setalvad must deposit a solvent security of ₹10 lakh and provide an affidavit affirming her return to India. Additionally, she is required to return her passport after the conference concludes.

Concerns About Zakir Naik

Solicitor General Tushar Mehta raised concerns about Setalvad’s travel, highlighting the presence of Zakir Naik in Malaysia. Naik, a fugitive from Indian law, is alleged to be involved in terrorism-related activities. Mehta argued that strict conditions were necessary to ensure Setalvad’s return, as her travel to Malaysia might raise concerns due to Naik’s presence. The Solicitor General’s objections contributed to the Court’s decision to increase the bail amount from ₹25,000 to ₹10 lakh.

Background of the Case

Teesta Setalvad, currently on bail in a case related to alleged fabrications in the 2002 Gujarat riots, was initially denied regular bail by the Gujarat High Court. However, in July 2023, the Supreme Court overturned this decision, granting her bail with the condition that her passport remain with the sessions court.
